Ministry of Labour Demands Submission of Employment Statistics

Employers nationwide have been urged to comply with legal requirements to submit employment relationship statistics or face penalties. 

Labour Commissioner Givens Muntengwa emphasized this directive in a circular issued by the Ministry of Labour and Social Security.

The mandate, rooted in Sections 12, 22, 50, 55, and 62 of the Employment Code Act No.3 of 2019, obliges employers to provide accurate data on employment relationships. 

According to Mr. Muntengwa, this data is vital for tracking labour market trends, which inform policy and legal reforms aimed at improving Zambia’s labour environment.

The Commissioner expressed concern over low compliance levels, which have hindered the Ministry’s efforts to maintain an updated labour database. Non-compliance, he warned, may attract penalties under Sections 12(3), 133(1), and 135 of the Act.

Employers are required to send hard copies of the statistics to the Labour Commissioner’s office at the New Government Complex or by post. Soft copies can be emailed to mlss@info.gov.zm or Mukamasole.Kasanda@mlss.gov.zm.

Additionally, Mr. Muntengwa reminded employers of their obligation to pay wages in Zambian Kwacha as stipulated in Section 67(1) of the Act. Employees, however, retain the right to choose the mode of payment, including postal order, cheque, or electronic payment systems.

Failure to comply with these legal provisions, Mr. Muntengwa warned, will result in necessary sanctions.
